i think i will risk it. it may clarify a few concepts for me.
there is a hadith about when the prophet woke up a litle late for fajr. he did not pray it right away becuase it was in that time. he waited until it was even more late until he prayed. this is from br. thomas at MSA halaqa...i'll try to get confirmed source...t2 was there!

What I remember is this:
you cannot pray fajr Between - when you see sun just rising and when sun is at the height of a spear (if you hold a spear, it should be above it).
so, if you see sun (even a little bit) then dont pray until u see sun up to the height of spear (you are holding in hand)...

As I understand, the time of prayer is not in your hands. So it cannot be 'haraam' if you accidentally pray at these mentioned times.
If something can be controlled by you, and you do it that will be haraam.
I believe it will be makrooh until you can definitely show that it is haraam.
